1. Acceptance of Terms

AR3NA Fitness Racing ("AR3NA," "we," "us," or "our") is a fitness racing and performance tracking platform operated by REDWAVE Infrared Studio LLC.

These Terms of Use ("Terms") govern access to and use of AR3NA websites (including ar3na.app and ar3nafitnessracing.com), applications, race timing systems, leaderboards, performance tracking, and related services (collectively, the "Services").

By creating an account, affirmatively accepting these Terms, or otherwise using features that require their acceptance, you agree to comply with them.

Additional rules, participation agreements, or waivers may apply to specific competitions, facilities, and events.

2. Age Requirements

All AR3NA athletes must be at least 18 years old.

By registering or participating, you represent that you are 18 or older.

AR3NA may collect your date of birth solely to verify your eligibility.

Your date of birth is not displayed on public profiles, race boards, or leaderboards.

Accounts belonging to individuals under 18 may be suspended or terminated.

3. Athlete Registration and Phone Authentication

AR3NA uses mobile phone numbers and one-time text-message codes for athlete authentication.

To register or sign in, you must provide a valid mobile phone number capable of receiving the required verification messages.

You agree not to knowingly register using another person's phone number without authorization.

By requesting an authentication code, you authorize AR3NA and its service providers to send the requested transactional verification messages.

These messages are used for login and account security, not promotional marketing.

Carrier messaging or data charges may apply.

You are responsible for maintaining control of your registered phone number and notifying AR3NA of suspected unauthorized account access.

Email addresses are optional unless separately requested for a disclosed feature or purpose.

4. Gamer Tags

AR3NA uses gamer tags as the standard athlete-facing identity during competitions.

Athletes may choose gamer tags that do not reveal their real names.

Gamer tags may appear on live race displays, gym leaderboards, achievements, and public rankings according to applicable participation and visibility settings.

Gamer tags must not impersonate another individual, infringe intellectual property rights, or contain unlawful, threatening, or abusive content.

AR3NA may require changes to gamer tags that violate these rules.

Using a gamer tag provides an additional layer of privacy but does not guarantee complete anonymity.

5. Description of Services

AR3NA offers interactive fitness racing and performance tracking technology.

Features may include:

Features may vary by participating facility, event, and account type.

AR3NA may modify or discontinue features subject to applicable law and contractual obligations.

6. Participating Gyms

AR3NA may provide technology to independently operated gyms, studios, and event organizers ("Participating Gyms").

Unless expressly stated otherwise, Participating Gyms are responsible for the physical operation of their workouts and competitions.

This includes appropriate equipment, supervision, participant instruction, eligibility procedures, physical safety practices, and required participation waivers.

Providing software does not automatically make REDWAVE Infrared Studio LLC the operator of a Participating Gym or the organizer of every event using AR3NA technology.

7. Competition Rules and Athlete Responsibilities

Athletes agree to comply with the applicable rules of each AR3NA race or competition.

Rules may establish movement standards, repetition requirements, equipment categories, scoring methods, division eligibility, and verification procedures.

Athletes agree to submit accurate performance information and compete fairly.

AR3NA and authorized event administrators may investigate, correct, invalidate, or remove results affected by errors, rule violations, or manipulation.

Cheating, impersonation, intentional score falsification, or interference with race technology may result in disqualification or account suspension.

8. Live Race Displays and Leaderboards

During AR3NA-enabled competitions, an athlete's gamer tag and relevant performance information may appear on shared displays.

Such information may include race progress, times, scores, rankings, and competition categories.

Athletes understand that information displayed during a live race may be viewed by coaches, other participants, and spectators.

Gym-specific results may remain available to authorized facility personnel for legitimate competition administration purposes.

9. Public and Cross-Gym Rankings

AR3NA may offer optional public rankings that compare athletes across gyms and geographic regions.

Enrollment in broader public rankings requires an applicable participation or visibility choice.

Public competition information may include gamer tag, gym affiliation, competition division, race time, score, and ranking.

An athlete's phone number, date of birth, email address, and private account information are not part of standard public ranking displays.

Declining optional public rankings may affect eligibility for associated placements, awards, or achievements.

Official competitions may have separate disclosed rules requiring publication of certain results as a condition of entry.

10. Accuracy of Scores

AR3NA makes reasonable efforts to maintain reliable timing, scoring, and performance records.

However, manual errors, software issues, device failures, connectivity interruptions, and other circumstances may affect results.

AR3NA does not guarantee that every score is error-free or that performances at different facilities are directly comparable in all circumstances.

Competition administrators may review and correct results in accordance with applicable rules.

Home races are recorded by the athlete on their own device and are labelled self-reported. They appear only on home leaderboards and are not official results. AR3NA may hide or remove home results that appear implausible or that other athletes report.

11. Ghost Racing and Historical Comparisons

AR3NA may allow athletes to compare current performances with previous race results using digital Ghost racers or other comparison tools.

These comparisons are generated from recorded performance information and may not represent an athlete's exact physical movement in real time.

The sharing of identifiable historical records belonging to other athletes will be governed by applicable privacy settings and competition permissions.

Experience Points, Ranks, Badges, and Invites

AR3NA may award experience points, ranks, badges, and similar recognition based on race history. They have no monetary value and cannot be bought, sold, transferred, or exchanged for money, prizes, or discounts. They may be recalculated when results are corrected or voided.

Athletes may earn invite credit when a friend who joined through their personal invite link completes an official race. No payment or prize is given for invitations.

12. Fitness and Safety

Fitness racing and strenuous exercise involve inherent physical risks.

Athletes are responsible for participating within their abilities and following appropriate safety instructions.

Participants should consult qualified healthcare professionals when they have concerns about their readiness for strenuous activity.

AR3NA's software, scores, competition rankings, and performance information are not medical advice.

Physical participation may require separate waivers administered by the Participating Gym or event organizer.

Nothing in these Terms removes legal rights or protections that cannot lawfully be waived.

13. Personal Information and Privacy

AR3NA handles athlete information according to its Privacy Policy, available at:

https://ar3na.app/privacy

Athletes retain applicable rights relating to their personal information.

Participation in a live gym race does not automatically authorize publication of an athlete's entire personal performance history across the AR3NA network.

Optional broader public visibility is governed by the applicable settings, enrollment choices, and competition rules.

14. Account Deletion

Athletes may request deletion of their AR3NA accounts and gamer tags.

Requests may be submitted at:

https://ar3na.app/delete-account

Or by contacting:

support@ar3na.app

Following a valid deletion request, AR3NA will delete or appropriately de-identify associated personal information, subject to applicable legal obligations and retention exceptions.

This includes the registered mobile phone number, gamer tag, account credentials, profile information, and identifying links to personal performance records, except where limited lawful retention is necessary.

Account deletion ends access to personal race history, account-specific achievements, and saved Ghost records.

AR3NA may retain genuinely de-identified or aggregated competition data for statistical analysis and platform improvement.

Retained information may include non-identifying race results and, where separately collected and appropriately de-identified, generalized competition or demographic categories.

Such information must not reasonably identify the former athlete.

Certain lawful competition records, independently maintained gym information, and third-party photographs or recordings may remain subject to separate rules or legal requirements.

15. User Content and Performance Information

Athletes may submit gamer tags, profile information, performance records, feedback, and other content.

Users retain ownership of their original content.

By submitting content, users grant AR3NA a non-exclusive, worldwide, royalty-free license to process, store, transmit, and display it as reasonably necessary to operate the Services and provide the competition features they have authorized.

This license does not independently permit unrestricted use of identifiable athlete photographs, likenesses, or testimonials in unrelated advertising.

AR3NA may use appropriately de-identified or aggregated performance information for lawful analytics and product improvement as explained in the Privacy Policy.

16. Photography and Events

AR3NA competitions may occur at facilities where photographs or videos are recorded.

Participating Gyms and event organizers are responsible for obtaining required permissions and providing appropriate notices relating to their events.

Certain official AR3NA competitions may require separate media releases or event agreements.

These Terms do not automatically grant AR3NA unrestricted permission to use an athlete's identifiable likeness for unrelated promotional campaigns.

17. Prohibited Activities

Users may not:

Violations may result in result correction, disqualification, suspension, or termination.

18. Intellectual Property

The AR3NA name, trademarks, logos, software, race technology, graphics, interface designs, and related proprietary materials belong to REDWAVE Infrared Studio LLC or its applicable licensors.

Users receive a limited, non-exclusive, non-transferable license to use the Services for their intended purposes.

Unauthorized reproduction, redistribution, reverse engineering, or commercial exploitation is prohibited except where applicable law permits otherwise.

19. Third-Party Services

AR3NA may rely on third-party technology providers for authentication, SMS delivery, hosting, database services, and other operational functions.

Participating Gyms and other independent providers may have separate terms governing their services.

AR3NA is not responsible for independent third-party conduct beyond its applicable legal and contractual obligations.

20. Fees and Purchases

Some AR3NA Services may be included in a Participating Gym's membership or offered without separate athlete fees.

Other competitions, features, or services may require payment.

Applicable pricing, payment terms, refund conditions, and cancellation requirements will be disclosed before purchase.

Transactions administered independently by Participating Gyms may be governed by those organizations' separate terms.

21. Suspension and Termination

AR3NA may suspend or terminate access when reasonably necessary because of material Terms violations, cheating, fraudulent registration, security threats, unlawful conduct, or discontinuation of Services.

Where appropriate, we may provide notice and an opportunity to address the issue.

Account termination and personal data deletion are separate processes governed by applicable law and our Privacy Policy.

22. Service Availability and Disclaimers

AR3NA strives to provide reliable competition technology but cannot guarantee uninterrupted, completely accurate, or error-free operation.

To the extent permitted by applicable law, the Services are provided on an "as is" and "as available" basis.

AR3NA does not guarantee specific fitness improvements, competitive results, rankings, or achievements.

Mandatory legal and consumer protections remain unaffected.

23. Limitation of Liability

To the maximum extent permitted by applicable law, REDWAVE Infrared Studio LLC and applicable service providers are not responsible for indirect, incidental, special, or consequential damages resulting from use of the digital Services.

Subject to mandatory legal protections, aggregate liability arising from the digital Services will not exceed the greater of the amount paid directly by the user to AR3NA during the preceding 12 months or US $100.

These limitations do not apply to liabilities that cannot lawfully be excluded or limited.

This section does not replace physical participation waivers or eliminate rights relating to injury or other claims where prohibited by law.

24. Governing Law and Disputes

These Terms are governed by the laws of the State of Ohio, United States, without regard to conflict-of-law rules, subject to mandatory consumer protections that may apply in other jurisdictions.

Users are encouraged to contact AR3NA to attempt to resolve disputes informally.

Where formal proceedings are required, applicable jurisdiction and procedures will be determined under governing law and mandatory legal protections.

25. Changes to Terms

AR3NA may modify these Terms to reflect changes in our Services, operations, or legal requirements.

Updated Terms will be posted on our website, and notice or renewed agreement will be provided where required.
